How it started · editorial summary

The owner’s silence did not replace review of invoice grounds, payments and late-payment interest.

The dispute and the court’s decision

Narva linn, Madise tn 6 korteriühistu claimed management charges and late-payment interest from owner XX. The owner received the documents but did not respond. In non-contentious proceedings, the court independently examined the basis and amount: issuing invoices alone is insufficient. It established meeting resolutions setting rates, a valid management plan and supplier costs. Heating was allocated by floor area, water and gas by readings and supplier prices. A late increase for a new period was left unexamined because it followed the deadline and would require a fresh opportunity to respond. A separate application for the new period remains possible. The court checked allocation of two payments: without selection of a particular obligation, the statutory sequence applied, first costs and late-payment interest, then principal. Late-payment interest was checked using the exact statutory annual rate rather than the association’s rounded daily rates. Principal recovery was limited to the amount claimed although the calculated balance was higher. The original late-payment interest claim was partly refused; the remaining accrued late-payment interest and further statutory late-payment interest on unpaid principal from 22 August 2026 until payment were awarded. Costs were reduced from the 800 euros sought to 560 euros: a 50-euro fee and 510 euros for legal assistance. The late increase and some representative time were not reimbursed. The order does not establish performance of the award.

Outcome of this decision

The application was allowed in part; debt and late-payment interest were awarded and costs reduced. The late increase for a new period was left unexamined.

How it started · editorial summary

Under its terms, breach of the schedule permits the association to treat the agreement as invalid.

The dispute and the court’s decision

Narva linn, V. Gerassimovi tn 16 korteriühistu and debtor XX submitted a written settlement after service of a payment proposal in expedited payment-order proceedings. The case was transferred from Pärnu Maakohus to Viru Maakohus for approval. The court examined permissibility and enforceability, approved the settlement before non-contentious proceedings began and discontinued the case. The debtor acknowledged management and utility arrears payable over twelve months. The agreement does not release the debtor from current monthly payments. On improper performance, including full or partial non-payment of at least one scheduled instalment, the association may unilaterally treat the agreement as invalid. The order approves that condition but does not establish its actual use or performance of the schedule. Each party bears its own costs without reimbursement.

Outcome of this decision

A twelve-month settlement schedule was approved and the case discontinued. Current payments remain due.

How it started · editorial summary

The settlement distinguishes scheduled debt from the statement about current charges.

The dispute and the court’s decision

Narva linn, Soldina tn 18c korteriühistu sought payment from two debtors XX in expedited payment-order proceedings. The proposed schedule contained additional conditions, so the case was transferred to Viru Maakohus. After clarification, the participants submitted a new settlement, which the court approved before non-contentious proceedings began and discontinued the case. The acknowledged obligation includes principal, late-payment interest and costs, with six monthly payments. Initial dates precede the order, but performance was not established. A delay exceeding ten calendar days permits the association to seek enforcement of the judicial settlement. The statement about current charges expressly creates no independently enforceable obligation under this settlement. After the final payment, the debt is treated as paid. Additional costs remain with the participants.

Outcome of this decision

Six payments were approved; delay exceeding ten days permits an enforcement application. The case was discontinued.

Breach of the schedule makes the entire obligation immediately payable; upon breach, the association may also claim late-payment interest of 0.02% per day solely on the principal specified in the settlement, running from 1 June 2026. How it started · editorial summary

Payment after filing did not eliminate costs, but the court reduced their amount.

The dispute and the court’s decision

Narva linn, Madise tn 6 korteriühistu claimed management-charge arrears from owner XX. During proceedings, the association confirmed payment of the principal claim and withdrew its application. The owner disputed the need for proceedings and the costs claimed. The court accepted the withdrawal and discontinued proceedings. Costs were placed on the owner because the debt existed when the application was filed and was paid later, making the proceedings objectively justified. The principal debt was not awarded again. Of the 350 euros claimed in costs, the court awarded 100 euros: a 50-euro state fee and 50 euros for necessary work by the contractual representative. It refused 250 euros for preparing the original application because a board member represented the association then and the contractual representative joined later. Statutory interest runs on the awarded costs from finality of the order until payment; performance was not established.

Outcome of this decision

Following payment of principal, proceedings were discontinued; only 100 euros in costs and statutory interest on them were awarded.

How it started · editorial summary

The association sought disposal of the apartment but waived its claim after sale and repayment of the debt.

The dispute and the court’s decision

Narva linn, Uusküla tn 17 korteriühistu brought a claim requiring owner XX to dispose of the apartment. It relied on maintenance arrears and failure to implement the owners’ decision on disposal. During the case, the association reported that the defendant had already sold the apartment and paid the debt in full. It later clarified that it was waiving the claim and requested refund of half the court fee. On 6 March 2026, the court accepted the waiver and ended proceedings without a decision on the merits. The ruling imposed no duty to sell: the stated reason to continue the dispute had by then ceased. The court explained the consequences of waiver, including inability to repeat the same dispute between the same parties on the same grounds. The court ordered a refund to the association of 212,50 euros, half the 425-euro fee paid. Each party retained its other costs. The court noted that, after explanation of the possibility of claiming costs, the association no longer requested them in its final document and treated this as an intention not to recover them from the defendant.

Outcome of this decision

Accept the waiver and terminate proceedings. Refund the association 212,50 euros in court fees; each party bears its own costs.

The schedule does not establish payment; the settlement takes effect when the order becomes final.

The dispute and the court’s decision

Narva linn, Linda tn 1 korteriühistu and debtor XX submitted a settlement following the start of expedited payment-order proceedings. The court approved it before non-contentious proceedings began and discontinued the case. The acknowledged obligation covers utility and management-charge arrears and agreed costs; the association waived other claims. Payment is spread over 28 months, with early payment permitted. Some initial dates precede the order, but it does not establish performance. Full or partial delay in an instalment makes the entire unpaid balance recoverable in enforcement proceedings. Full performance leaves no mutual claims from this case. The settlement takes effect when the approving order becomes final; a separate effectiveness clause was removed. By agreement, the appeal period was shortened to two days from service. Costs outside the settlement remain with each participant.

Outcome of this decision

The settlement was approved and proceedings discontinued; breach of the 28-month schedule permits recovery of the balance.

How it started · editorial summary

The association sought management and utility charges from OÜ Peremaakler. The appeal court later reduced the principal; the late-payment interest proceedings were discontinued following the association’s withdrawal.

The dispute and the court’s decision

Narva linn, Pähklimäe tn 11 korteriühistu sought management, heating and water charges from OÜ Peremaakler for 01.02.2020–07.10.2021. Following the company’s objection, the dispute continued outside expedited payment-order proceedings. The final claim was 1,147.44 euros. The association withdrew its claim for late-payment interest. The company disputed water charges on the ground of no consumption and raised the treatment of proceeds from the property’s sale. The first-instance court checked invoices, readings, handover records and approved tariffs. It found that the company had provided no specific alternative calculation, while the association had proved the composition and allocation of costs. It found that 350 euros obtained in enforcement had been applied to an earlier debt awarded in another case, rather than the period at issue here. The first-instance court awarded the principal and discontinued the withdrawn late-payment interest claim. On 29 January 2026, Tartu Ringkonnakohus reduced the award to 1,117.62 euros: water charges of 29.82 euros did not match the handover-record readings. Crediting 350 euros against the earlier debt was left unchanged. Costs in both instances were allocated 97% to OÜ Peremaakler and 3% to the association, with the amount to be determined separately. Discontinuance of the withdrawn late-payment interest claim remained unchanged.

Outcome of this decision

The original award was 1,147.44 euros. On 29 January 2026, Tartu Ringkonnakohus reduced it to 1,117.62 euros and dismissed the claim for 29.82 euros. The withdrawn late-payment interest claim was discontinued. Costs in both instances were allocated 97% to the company and 3% to the association, with the amount to be fixed separately.

How it started · editorial summary

Water readings in the handover record changed part of the award, but a payment on earlier debt did not reduce this claim.

The dispute and the court’s decision

Narva linn, Pähklimäe tn 11 korteriühistu sought 1147.44 euros in management charges from OÜ Peremaakler for 1 February 2020 until ownership ended on 7 October 2021; the association withdrew late-payment interest. The company disputed water charges and allocation of a 350-euro receipt. It appealed the order after the first-instance court allowed the principal in full. The appellate court admitted additional documents permissible in support of such an appeal. Final water readings in the handover record were lower than those used in the invoices. The excess 29.82 euros was therefore refused, leaving an award of 1117.62 euros. The court upheld the other charges. The 350-euro receipt discharged an earlier obligation established by another court order; the balance of that debt was not the balance claimed here. Discontinuance of the late-payment interest claim remained in force. Costs in both instances were allocated 97% to OÜ Peremaakler and 3% to the association. The first-instance court will quantify costs after the order becomes final. Performance of the award was not established.

Outcome of this decision

The appeal against the order was allowed in part: the award was reduced to 1117.62 euros and 29.82 euros refused; costs were reallocated.

After full repayment, the association waived its application and requested half the fee back and the remainder from two debtors XX.

The dispute and the court’s decision

Narva linn, Joala tn 13, Joala tn 15, Kose tn 1a, Kose tn 3 korteriühistu sought debt from two individuals XX. During the case it supplied a payment document confirming full repayment. After a clarifying court question, it expressly waived its application, sought termination and refund of half the fee paid. It requested the other half against the debtors. On 16 December 2025 the court accepted the waiver and terminated proceedings. The basis was satisfaction during proceedings, confirmed by the payment document. The court did not award principal again or approve a settlement. Costs were allocated to both interested persons jointly and severally: one common 25 euro amount was awarded to the association, recoverable from either, rather than 25 euros from each. The court applied the costs rule for waiver after the other party satisfies the demand following the application to court. A further 25 euros, half the fee, is to be refunded to the association from the budget after entry into force. The refund and joint and several reimbursement of the remainder are two separate outcomes.

Outcome of this decision

Accept the waiver and terminate the case. Award 25 euros in costs jointly and severally against the two interested persons; refund the association a further 25 euros in fees after entry into force.
