The dispute and the court’s decision
Narva linn, A. Puškini tn 45a korteriühistu, named in the source as Puškini 45A Korteriühistu, claimed 2500 euros from individual XX for management and utility charges. Following a default judgment of 14 January 2013, the defendant lodged an application to set aside the default judgment (kaja) and proceedings were reopened on 3 September.
On 28 October the association withdrew because the debt had been paid. The court found that, after the claim was filed on 13 August 2012, the obligation had been fulfilled by 17 October 2012. Its order of 6 November 2013 accepted the withdrawal and ended proceedings. It did not make a new principal-debt award.
Of the 400 euros in costs requested, the court awarded a 200-euro court fee and 150 euros for legal assistance. The fee exceeding the reduced rate remained with the association. Reimbursement of the defendant’s 200-euro kaja security payment was reserved for a separate order after payment details were clarified. That outcome and subsequent appeals have not been checked.
Outcome of this decision
Proceedings ended following withdrawal after payment. A 200-euro court fee and 150 euros in legal costs were awarded; the security refund remained undecided.
