Kangelaste prospekt 9: debt claim left unexamined because defendant was bankrupt
Ruling · Viru Maakohus · First instance
Narva linn, Kangelaste prospekt 9 korteriühistu · 80170532
Entry into force has not been reverified
Participants and roles: Claimant – Narva linn, Kangelaste prospekt 9 korteriühistu; Defendant – XX
Editorial summary
The ordinary claim was filed after the debtor was declared bankrupt while bankruptcy proceedings were still ongoing.
The dispute and the court’s decision
The court left the apartment association Kangelaste prospekt 9 claim unexamined because debtor XX had already been declared bankrupt when it was filed and bankruptcy proceedings were continuing. Narva linn, Kangelaste prospekt 9 korteriühistu brought a debt claim against XX. Viru Maakohus found that the defendant was declared bankrupt on 2 November 2018, proceedings remained ongoing and this claim was filed on 8 July 2019, after the bankruptcy declaration.
The court explained that in these circumstances a creditor must pursue the relevant demand under bankruptcy legislation, rather than by a separate ordinary claim. Until the bankruptcy proceedings end, the chosen route cannot achieve the recovery sought.
The claim was therefore left unexamined. The court did not determine on the merits whether a debt existed, its amount or whether XX had to pay it. The ruling addresses the procedure for bringing the demand; it does not mean that the debt has been repaid or is absent.
All litigation costs were left with the association. The court identified no defendant costs requiring reimbursement. The ruling also explained the possibility of bringing certain unsatisfied claims or claims not filed in bankruptcy after that procedure ends under the statutory rules. It did not determine the subsequent fate of the association’s claim in bankruptcy.
Outcome of this decision
Leave the claim unexamined; the association bears costs. The existence and amount of debt were not decided on their merits.
Joala 11 Narva: partial compensation for damage caused during firefighting
Judgment · Viru Maakohus · First instance
Korteriühistu Joala 11 Narva · If P&C Insurance AS · 80189885 · 10100168
Entry into force has not been reverified
Participants and roles: Claimant — owner XX; Defendant — Korteriühistu Joala 11 Narva; Third party on the defendant’s side — If P&C Insurance AS
Editorial summary
The court found the association liable for damage during firefighting but accepted only part of the loss claimed.
The dispute and the court’s decision
The court partly granted owner XX’s claim against the apartment association Joala 11 Narva and awarded 2 647,72 euros for apartment damage during firefighting. Owner XX sought compensation from Korteriühistu Joala 11 Narva for water damage during extinguishing an attic fire on 15 January 2014. The final claim was 18 186,32 euros. The association disputed liability and the amount of loss. Insurer If P&C Insurance AS participated on its side as a third party without an independent claim.
After the appeal court set aside an earlier dismissal, the county court reconsidered the case. It found the association the proper defendant: maintaining common property and ensuring safety were its duties. From witness testimony and Rescue Board materials, it concluded that one attic entrance had been unlocked. In the court’s view, this allowed outsiders in and led to the fire during whose extinguishing the apartment was damaged.
However, the claimant did not prove the entire amount sought. The assessments submitted were made more than a year after the fire and could not reliably separate firefighting damage from earlier defects. The court preferred inspection materials prepared soon after the event and the corresponding restoration estimate.
The claim was partly granted, with 2 647,72 euros awarded against the association. Each participant bears its own court costs. The court applied the law in force when the damage arose. Use of the decision in a new dispute should take account of subsequent legislative changes and the specific circumstances.
Outcome of this decision
Partly grant the claim: award XX 2 647,72 euros against Korteriühistu Joala 11 Narva. Each participant bears its own court costs.

Editorial summary
The design fee dispute depended on the agreed window count, fire safety and the client’s acceptance of the result.
The dispute and the court’s decision
The court dismissed OÜ NARVA EHITUSPROJEKT’s claim for the remaining facade design payment from the apartment association A. Daumani tn 9 because the work did not meet agreed terms. OÜ NARVA EHITUSPROJEKT sought 2 016 euros outstanding for a facade reconstruction design, late-payment interest and 40 euros in recovery costs from Narva linn, A. Daumani tn 9 korteriühistu. The association had paid a 504 euro advance but refused the final design and ended the contract. The disputed term was the number of basement windows: the client insisted on 15, while the designer invoked fire safety requirements and supplied a version with more.
The court found 15 windows an agreed essential term despite the number not being separately stated in the signed contract. This followed from the initial design, correspondence and explanations. The design also had to meet mandatory safety requirements.
The first version lacked the necessary smoke extraction analysis. The later version took fire safety requirements into account but departed from the agreed window count without client consent. Neither version therefore complied with the contract. Administrative approval alone did not replace compliance with contractual terms.
The association objected in time and refused acceptance. The court treated its termination notice as lawful withdrawal from the contract for breach. The designer also withheld permission to use the work until full acceptance, so there was no basis to pay for a separately delivered part. The claim was dismissed in full, with costs allocated to the designer and the amount set later. The court did not assess another provider’s design or the lawfulness of its approvals.
Outcome of this decision
Dismiss OÜ NARVA EHITUSPROJEKT’s claim in full. The claimant bears all court costs, with the amount determined after entry into force.
A-A. Tiimanni 4: payment before the hearing did not free association from costs
Ruling · Viru Maakohus · First instance

Entry into force has not been reverified
Participants and roles: Claimant — OÜ NBarts Büroo; Defendant — Narva linn, A-A. Tiimanni tn 4 korteriühistu
Editorial summary
The service debt was paid before the hearing; the court resolved the remaining costs dispute.
The dispute and the court’s decision
After payment for the service, the court terminated the case and awarded OÜ NBarts Büroo 155 euros in costs against the apartment association A-A. Tiimanni tn 4. OÜ NBarts Büroo had sued Narva linn, A-A. Tiimanni tn 4 korteriühistu for a service costing 155 euros. The association withheld payment, considering that the provider first had to sign a written contract and issue an invoice on that basis. The disputed sum was transferred on the eve of the hearing.
At the hearing the claimant waived the claim and sought costs against the association. The defendant argued it had given no cause for litigation. The court accepted the waiver and terminated proceedings because the monetary demand had been satisfied.
When allocating costs, the court found that the service had been ordered and provided and a contract could arise through an exchange of declarations without a separately signed text. Requiring a written document did not justify delayed payment. Payment only just before the hearing also caused additional attendance costs. Costs were therefore allocated to the association.
However, the court capped compensation at the claim value. The case was not particularly complex or extensive, and the claimant could have ended the dispute earlier by agreeing to document the contract in writing. The association was ordered to pay 155 euros in costs: a 37,50 euro fee and 117,50 euros for a representative’s assistance. This is a separate costs award, not recovery again of the paid service. Refund of an excessive fee and part of the proper fee requires the payer’s application.
Outcome of this decision
Accept waiver and terminate proceedings. Award OÜ NBarts Büroo 155 euros in court costs against the association.
Võidu prospekt 6: instalments with conditional suspension of late-payment interest
Ruling · Viru Maakohus · First instance
Narva linn, Võidu prospekt 6 korteriühistu · 80170791
Entry into force has not been reverified
Participants and roles: Applicant — Narva linn, Võidu prospekt 6 korteriühistu; Interested person — XX
Editorial summary
The agreement makes late-payment interest relief conditional on following the debt schedule and regulates costs separately.
The dispute and the court’s decision
Narva linn, Võidu prospekt 6 korteriühistu sought management cost debt from XX. The participants reached a settlement, which Viru Maakohus approved, terminating proceedings.
The debtor acknowledged principal and accrued late-payment interest. Payment is provided over 17 months in monthly instalments. XX must also pay current association invoices within their stated deadlines.
If the schedule is performed properly and on time, the association suspends late-payment interest on principal from the agreed date. On breach, the debtor loses that concession and late-payment interest on principal resumes from the same date. The agreement therefore grants conditional relief, rather than an unconditional waiver of all late-payment interest.
XX must also pay the association 45 euros in court costs within three months of settlement approval. Delay in paying that particular sum carries late-payment interest of 0,2% per day on the unpaid balance. Each party bears other costs. The association was awarded a 25 euro refund, half the proper fee, and a separate 150 euro overpayment refund. The ruling does not confirm actual performance.
Outcome of this decision
Approve the agreement and terminate the case. Debt and accrued late-payment interest are paid monthly over 17 months; current invoices are paid separately. Compliance suspends late-payment interest on principal from the agreed date; breach restarts it from that same date. Pay a further 45 euros in costs within three months, with late-payment interest of 0,2% per day if those costs are late. Refund the association a 25 euro fee and a 150 euro overpayment.

Editorial summary
The circuit court examined special appeal admission conditions in a case involving a small claim.
The dispute and the court’s decision
The circuit court refused to admit XX’s appeal in the apartment association Kangelaste 42’s simplified case, finding no grounds for admission. Korteriühistu Kangelaste 42 had obtained an award of management cost debt and accrued late-payment interest against defendant XX in the county court. Further statutory late-payment interest on principal was also awarded and costs allocated to the defendant. XX appealed, alleging breaches of legal rules, and requested state legal aid.
Tartu Ringkonnakohus was deciding whether to admit the appeal. The case concerned a small monetary claim under the simplified procedure, subject to special appeal conditions. The court checked for an obvious misapplication of law, material procedural breaches or clearly incorrect assessment of evidence capable of affecting the outcome.
The circuit court found none. It considered that the county court had examined charges, facts and evidence in detail and applied the relevant rules. The defendant’s disagreement with the outcome alone did not suffice for admission.
The court refused to admit the appeal and deemed it returned to the applicant. This is an appeal admission ruling, not a new award of the same sums. The legal aid application was left undecided. The unpaid appeal fee was not required because the appeal was not admitted. A separate possibility to challenge the refusal itself is provided.
Outcome of this decision
Refuse to admit XX’s appeal and deem it returned. Leave the state legal aid application undecided; no fee is payable for the appeal that was not admitted.
Association debt: crediting payments and interest across different periods
Judgment · Viru Maakohus · First instance
Narva linn, Kangelaste prospekt 42 korteriühistu · 80175430
Entry into force has not been reverified
Participants and roles: Claimant — Narva linn, Kangelaste prospekt 42 korteriühistu; Defendant — XX
Editorial summary
The association sought debt and late-payment interest. XX challenged the calculation, payment allocation and tariff resolutions. The court found the calculation proved and granted the claim.
The dispute and the court’s decision
Narva linn, Kangelaste prospekt 42 korteriühistu, formerly KÜ KANGELASTE 42, sought management and utility debt with late-payment interest from XX. XX accepted a general duty to contribute but disputed the amount, citing missing emailed invoices, unclear tariffs, defects in repeat meetings and incorrect crediting of payments.
The court compared invoices, the consolidated calculation and payment records. The association agreed to apply payments to principal for the months specified by XX, and the court found this reflected in the final calculation. Objections to tariff resolutions did not establish nullity or timely challenge; the court treated the resolutions as valid.
Accrued late-payment interest was checked separately for periods before and after the 2018 legislative change and found substantiated. The claim was granted: principal, accrued late-payment interest and continuing late-payment interest on unpaid principal from 1 January 2019 at the ECB rate determined for each half-year plus 8 percent annually were awarded until principal is paid. Costs were imposed on XX, with their amount to be determined separately. Actual payment of the award was not established.
Outcome of this decision
The claim was granted: the association was awarded principal, accrued late-payment interest and continuing late-payment interest on unpaid principal from 1 January 2019 at the ECB rate determined for each half-year plus 8 percent annually until principal is paid. XX bears their own and the association’s costs, the latter to be fixed separately.
Participants and roles: Claimant – Korteriühistu Puškini 45; Defendant – owner XX
Editorial summary
The court granted the claim by default after no response within the time limit.
The dispute and the court’s decision
Korteriühistu Puškini 45 brought a claim against owner XX for management expense arrears and late-payment interest. Documents were served through a representative, and the court set a written response deadline and warned of a possible default judgment. The defendant neither responded nor objected in time. The association asked for a default decision.
Viru Maakohus granted the claim. Under this procedure, the claimant’s factual allegations are deemed admitted because no timely response was made; the court also checks whether they legally support the demand. This is a procedural feature of a default judgment, rather than an account of the defendant’s position in the dispute.
XX was ordered to pay principal and accrued late-payment interest. Continuing late-payment interest of 0,07% per day was awarded on principal until performance. The court also awarded 1 334,20 euros in litigation costs and statutory late-payment interest on their unpaid amount from finality until payment.
The judgment was declared immediately enforceable without security. The defendant was informed of the right to apply to the county court to set aside the default judgment and reopen proceedings. As the judgment was to be served by public notice, the deadline is linked to when the defendant learned of the judgment or enforcement proceedings under it. This judgment does not confirm actual recovery of the sums.
Outcome of this decision
Award debt, accrued late-payment interest and 1 334,20 euros in costs against XX, plus continuing late-payment interest on the debt and costs. The default judgment is immediately enforceable without security.
Kraavi 12: repeated apartment damage claim refused admission
Ruling · Viru Maakohus · First instance
Narva linn, Kraavi tn 12 korteriühistu · 80310766
Entry into force has not been reverified
Participants and roles: Claimant – XX; Named defendant – Narva linn, Kraavi tn 12 korteriühistu
Editorial summary
The new application repeated a dispute already pending; the pecuniary part was also covered by an earlier final judgment.
The dispute and the court’s decision
The court refused to accept XX’s repeated apartment damage claim against the apartment association Kraavi tn 12, citing a pending dispute and an earlier judgment on the pecuniary demand. Claimant XX sought 6 676 euros in pecuniary and 500 euros in non-pecuniary damages from Narva linn, Kraavi tn 12 korteriühistu. He alleged that the apartment was damaged during repairs and promised remedial work was not done. Viru Maakohus was deciding whether to accept this claim.
The court found that the same claimant had already made a demand against the same association on the same circumstances in another case. Although acceptance there had previously been refused because defects were unremedied, that ruling was not yet final and its appeal period had not expired. The identical dispute therefore remained pending, preventing acceptance of a new claim.
The court also referred to a final judgment in an earlier dispute about the same damage: pecuniary compensation had been refused upon a finding that damage had not been caused. That result prevents resubmission of the same pecuniary demand.
For non-pecuniary harm, the court explained the special conditions for compensation where an item of particular personal importance is destroyed or lost. A demand to repair a damaged item does not itself replace proof of those conditions. The new claim was refused; all costs were left with the claimant, with none reimbursable. The ruling awards no monetary compensation and does not reopen the earlier pecuniary dispute on its merits.
Outcome of this decision
Refuse to accept the claim. The claimant bears costs; none are reimbursable.
Kraavi 12: non-pecuniary damage claim refused admission after defects remained unremedied
Ruling · Viru Maakohus · First instance
Narva linn, Kraavi tn 12 korteriühistu · 80310766
Entry into force has not been reverified
Participants and roles: Claimant – XX; Named defendant – Narva linn, Kraavi tn 12 korteriühistu
Editorial summary
After partial reversal of the earlier refusal, the court allowed time to clarify the non-pecuniary demand, but the papers were not corrected.
The dispute and the court’s decision
The court again refused to accept XX’s non-pecuniary claim against the apartment association Kraavi tn 12: after an extension, the claimant did not clarify the amount and circumstances of the harm. Claimant XX sought pecuniary and non-pecuniary damages totalling 7 668 euros from Narva linn, Kraavi tn 12 korteriühistu. He linked the demand to damage to the apartment during repairs and disagreed with the earlier dismissal.
The court initially refused to accept the new claim, citing a final judgment between the same parties. The circuit court set that refusal aside only as regards non-pecuniary damage and remitted acceptance of that part for reconsideration. The procedural ruling therefore did not reopen the pecuniary part.
After remittal, Viru Maakohus required a clear statement of the specifically non-pecuniary amount, the association’s particular acts or omissions, the nature of the harm and the evidence. The total demand did not show which portion concerned non-pecuniary compensation. The court also explained the special conditions for such compensation where an item is destroyed or lost and warned of the consequences of not remedying defects.
At the representative’s request, the deadline was extended to 1 April 2019, but no clarifications arrived. The court refused acceptance and ordered return of the application and attachments after the ruling becomes final. Costs were left with the claimant; none were reimbursable. This ruling addressed defects in the application, rather than establishing on the merits that no non-pecuniary harm existed.
Outcome of this decision
Refuse to accept the claim because defects were not remedied; return the application and attachments after the ruling becomes final. The claimant bears costs.
Kalda 4: application for debt against two co-owners refused admission
Ruling · Viru Maakohus · First instance
Narva linn, Kalda tn 4 korteriühistu · 80338859
Entry into force has not been reverified
Participants and roles: Applicant – Narva linn, Kalda tn 4 korteriühistu; Named debtors – co-owners XX and XX
Editorial summary
The court required clear allocation of the demand between two co-owners and justification of late-payment interest.
The dispute and the court’s decision
The court refused to accept the association’s application because defects were not remedied. Narva linn, Kalda tn 4 korteriühistu sought utility arrears from XX and XX. The apartment belonged to two persons as co-owners in shares. Viru Maakohus required clarification of the demand, but the defects were not remedied in time.
The court stated that the application must make each participant’s liability clear. In particular, the association had not explained whether it sought each person’s share of the debt or considered either person liable for the whole amount. The latter means joint and several liability and requires a legal basis to be stated.
The court found that the materials did not justify an award of the total against both as joint and several debtors. The late-payment interest calculation and accrual period were also unclear. The court could not supplement or change the subject matter on the applicant’s behalf.
The application was refused and returned to the association with attachments. All litigation costs were left with the association. It was informed of the right to request a fee refund separately. This ruling does not determine the existence of utility debt on the merits or establish each co-owner’s final monetary obligations. Its reason is an unclear demand that the association did not clarify after the court’s directions.
Outcome of this decision
Refuse to accept the application; return the papers to the association. The applicant bears costs. A court fee refund may be sought by separate application.
Tallinna mnt 46: debt repayment schedule approved with late-payment interest suspended

Participants and roles: Applicant – Narva linn, Tallinna mnt 46 korteriühistu; Debtor – XX
Editorial summary
The agreement provides for five payments and no additional late-payment interest until the agreed schedule ends.
The dispute and the court’s decision
The court approved a debt repayment settlement and terminated payment order proceedings. Narva linn, Tallinna mnt 46 korteriühistu had sought recovery of arrears from XX in expedited payment order proceedings. After the payment proposal was sent, the participants settled and submitted the agreement to Viru Maakohus for approval. The court found it permissible and terminated proceedings.
The debtor acknowledged arrears in mandatory payments, accrued late-payment interest, 22,50 euros* towards the court fee and 89,62 euros in legal expenses.
The schedule provides for five payments. Until the end of the agreed schedule, the association will not charge additional late-payment interest on unpaid sums. If the debtor misses a payment, the full agreed amount becomes immediately payable.
Each participant bears expenses not provided for in the agreement. In the operative part, the court ordered a refund to the association of half the fee, 22,50 euros*. The participants excluded the right to appeal the ruling. It records acknowledgment of the debt and how it is to be paid, but does not confirm receipt of payments. After termination by agreement, the same dispute between the same participants on the same grounds cannot be started again.
Outcome of this decision
Approve the agreement to pay the debt, late-payment interest, 22,50 euros* towards the court fee and 89,62 euros in legal expenses in five payments. No additional interest is charged until the agreed schedule ends. A missed payment makes the full agreed sum immediately payable. Terminate proceedings; order refund of 22,50 euros* in court fees to the association.
Tallinna mnt 42: application refused admission after debt payment, fee awarded against debtor
Ruling · Viru Maakohus · First instance
Narva linn, Tallinna mnt 42 korteriühistu · 80054903
Entry into force has not been reverified
Participants and roles: Applicant — Narva linn, Tallinna mnt 42 korteriühistu; Named debtor — XX
Editorial summary
The debt was paid before admission for further consideration; the court separately decided what happened to the fee.
The dispute and the court’s decision
The court refused to admit the application after payment of the debt and awarded the association 104,79 euros in costs against the debtor. Narva linn, Tallinna mnt 42 korteriühistu had applied to recover debt from XX in expedited payment order proceedings. The payment proposal could not be served and the case was transferred to Viru Maakohus. The court gave the association time to submit a proper application and pay an additional fee.
Before admission for further consideration, the association reported full payment and requested termination and a fee refund. The court explained that ordinary claim proceedings not yet begun could not be terminated, while another court had already ended the expedited procedure. Since the debt was paid, the monetary claim no longer needed protection. The court therefore refused admission.
The request for a fee refund from the budget was rejected. The fee had been paid for the expedited payment order procedure, and the court found no statutory refund grounds applicable here.
However, costs were allocated to the debtor because the claim was satisfied after the association applied to court. The association was awarded the paid 104,79 euro fee against XX. There were no other proven costs. The original debt is thus not awarded again; the ruling’s new monetary outcome is reimbursement of a court cost. The act confirms the report of debt payment, not payment of the reimbursement awarded.
Outcome of this decision
Refuse to admit the application; do not allow refund of the fee from the budget. Award the association 104,79 euros in court costs against XX.
