The dispute and the court’s decision
Claimant XX challenged the legal relationship underlying heating charges and a general meeting decision of Narva linn, Rakvere tn 87 korteriühistu, named in the source as Rakvere tn. 87 korteriühistu. At the hearing, the parties agreed to settle instead of pursuing all claims.
From the autumn 2013 heating season, the association must calculate the disputed apartment’s heating charges using 15% of its floor area; the condition also applies to subsequent owners of that apartment. The general meeting decision of 22 March 2012 is cancelled. The claimant waived the request to establish that earlier heating bills were unfounded. This does not set a general rate for other apartments.
The court found the agreement lawful and capable of performance, approved it and terminated proceedings. Each side bears its other costs; the claimant was exempted from paying the court fee and state legal-aid costs to the state, with legal-aid costs borne by the Republic of Estonia. Entry into force and subsequent appeals have not been reverified.
Outcome of this decision
The approved settlement calculates heating for the disputed apartment on 15% of its area from autumn 2013, cancels the meeting decision of 22 March 2012 and withdraws the earlier-bill claim. Proceedings ended; state legal-aid costs remained with the state.
