The dispute and the court’s decision
Korteriühistu Tallinna mnt 58, now Narva linn, Tallinna mnt 58 korteriühistu, sought registration of a new board and changes to restrictions on representation. After a meeting on 6 June 2013 lacked a quorum, a repeat meeting with the same agenda was scheduled for 13 June.
Tallinna Ringkonnakohus upheld the registrar’s refusal. The articles required at least seven days’ notice and provided no shorter period for a repeat meeting. Time began to run on the day after notification, so the chosen date did not allow the full period. The meeting was not authorised to adopt decisions.
Given that defect, it no longer mattered whether compliant attachments to the minutes were submitted later or sufficient members had attended. The appeal was dismissed and Pärnu Maakohus’s registration order of 20 June 2013 upheld.
Outcome of this decision
Refusal to register the board and representation changes was upheld and the appeal dismissed. Later documents and a possible quorum did not cure the defective notice period for the repeat meeting.

The dispute and the court’s decision
The claimant XX sought information and documents about building loans, repairs and insurance from KÜ Pähklimäe 7/11, now Narva linn, Pähklimäe tn 7 korteriühistu. Inspection was agreed during proceedings, copies were provided and the claimant withdrew the claim. The county court terminated proceedings and placed costs on the association. The association appealed costs alone.
The circuit court found that, before the claim, the association had already offered inspection where the documents were held and an opportunity to arrange a convenient time. Neither the provision applied nor the articles gave the claimant an independent right to demand copies. Later provision of copies therefore did not constitute admission or satisfaction of the claim for the costs rule governing withdrawal.
Termination of proceedings remained in place, but costs were allocated to the claimant. The association was awarded 291.54 euros: 280 euros for legal assistance and 11.54 euros for copies. Its claimed translation costs were not awarded. The claimant was exempted from paying a 300-euro court fee to the state. Costs of this appeal against the order are not recoverable.
Outcome of this decision
Only costs were reversed: XX was ordered to pay 291.54 euros to the association and exempted from the 300-euro fee payable to the state. Termination following withdrawal remained in place; costs of this appeal are not recoverable.

The dispute and the court’s decision
KÜ Punane Maja, now Narva linn, Tallinna mnt 33 korteriühistu, sought maintenance charges, water charges and late-payment interest from VETA-A Kaubamaja AS. A court-approved settlement from 2007 already governed the parties: the company contributed to maintenance but not common building repairs, undertaking repairs within its shop itself.
The company argued that the tariff included excessive costs and was unsupported for later years. The circuit court upheld the calculation: the association used a reduced tariff for the company and credited previous payments. Administrative costs could form part of maintenance; the objections did not establish a breach of the settlement. The association was entitled to reduce its monetary claim.
Parking restrictions did not justify withholding payment either. The company had not established a proper, due counterclaim sufficiently connected with the debt or the necessary conditions. A monetary claim for alleged loss was first specified on appeal and disregarded as a new argument. The court did not require a counterclaim action as the only possible defence.
The appeal was dismissed and the judgment of 25 October 2012 upheld: 6,356.13 euros in principal and 2,543.60 euros in interest, totalling 8,899.73 euros. The company bears costs in both instances; no independent entitlement to parking spaces was established by this judgment.
Outcome of this decision
The award against VETA-A Kaubamaja AS of 6,356.13 euros in principal and 2,543.60 euros in interest, totalling 8,899.73 euros, was upheld. The appeal was dismissed and the company bears costs in both instances.

The dispute and the court’s decision
The apartment association Puškini 10 sought payment from OÜ Filmarinar for building maintenance, earmarked contributions and services for the period from 1 March 2007 to 1 March 2011. After increases to the claim, the total was 6 030,64 euros. The association relied on an earlier agreement, meeting decisions, invoices and a schedule of charges. The defendant challenged the proof of costs, the documents and contractual grounds, as well as late-payment interest of 0,2% per day.
On 8 May 2012, Viru Maakohus granted the claim in full. On the defendant’s appeal, the circuit court decided the case without remitting it to the first instance. It stated that an association member’s duty to pay for management of the building arises from the law; the existence of a document called an agreement does not itself make the relationship contractual. However, grounds for treating the earlier agreement as invalid or terminated had not been properly pleaded or proved in these proceedings.
The court found the maintenance charge and earmarked roof repair contributions established by meeting decisions proven. For heating, waste collection and internet, however, the association’s invoices alone were insufficient: the actual costs and their allocation had to be proved. No additional evidence was submitted even after the appeal court invited it. That part of the claim was dismissed. The court also rejected the possibility of increasing by contract the statutory late-payment interest ceiling then applicable of 0,07% per day. The defendant’s allegations of damage were not determined as a counterclaim because no proper counterclaim had been filed.
The appeal was partly allowed. The first-instance judgment was set aside, and a new judgment awarded 4 440,26 euros: 2 195,98 euros in principal and 2 244,28* euros in late-payment interest. Costs at both instances were allocated 73% to OÜ Filmarinar and 27% to the association.
Outcome of this decision
Set aside the Viru Maakohus judgment of 08.05.2012. Issue a new judgment partly granting the claim: order OÜ Filmarinar to pay the apartment association Puškini 10 a total of 4 440,26 euros for 01.03.2007–01.03.2011, comprising 2 195,98 euros in principal and 2 244,28* euros in late-payment interest. Partly allow the appeal. Allocate first-instance and appeal costs: 73% to OÜ Filmarinar and 27% to the apartment association Puškini 10.

The dispute and the court’s decision
After a debt dispute, KÜ Puškini tn 12, now Narva linn, A. Puškini tn 12 korteriühistu, had to bear costs in both instances. The defendant XX sought quantification of legal costs. The county court awarded 200 euros for representation on appeal but refused additional first-instance costs; XX appealed that refusal.
The circuit court upheld the outcome. Recovery of representative’s costs required proof of procedural representation. In the first instance, the participant filed documents personally and the accompanying person acted as an adviser. Under the rules applied, those costs were not recoverable as representative’s costs. Representation in the circuit court, by contrast, had been established.
The association’s initial failure to object to the costs application did not oblige the court to accept every sum automatically: it could examine necessity and reasonableness. The order of 6 March 2013 was upheld and the appeal dismissed. Costs of the present appeal are not recoverable. The underlying debt claim was not reconsidered on the merits.
Outcome of this decision
XX’s appeal was dismissed and the award of 200 euros from the association upheld; additional first-instance costs were refused. Costs of this appeal are not recoverable, and the main dispute was not reopened.

The dispute and the court’s decision
Following a challenge to a meeting decision of KÜ Kangelaste pr 19, now Narva linn, Kangelaste prospekt 19 korteriühistu, first-instance costs fell on the association and appeal costs on claimant XX. Quantifying them, the county court awarded XX 399.45 euros and the association 824.15 euros. XX challenged both calculations; the association brought a cross-appeal against the order.
The circuit court reduced the association’s recovery. Reviewing the file, discussing positions and preparing the written speech partly overlapped, without adequate explanation in the earlier assessment. Reasonable legal work was assessed at four hours, or 400 euros; including the court fee, the total was 719.55 euros. The request to increase XX’s 399.45 euros was refused because the assessment of that representative’s work was justified. The court did not set these reciprocal obligations off into a single net amount.
The association’s cross-appeal was left unexamined. An independent, timely appeal against the order was necessary; receiving the other side’s appeal did not open a new period under cross-appeal rules for judgments.
The order of 17 January 2013 was varied only as to the association’s recovery. Each side bears its own appeal costs; the association bears the cross-appeal costs. The underlying meeting dispute was not reconsidered.
Outcome of this decision
XX’s liability to the association was reduced to 719.55 euros; XX’s award of 399.45 euros remained. The association’s cross-appeal was left unexamined; each side bears its own appeal costs, and the association bears cross-appeal costs.

In proceedings against KÜ Suur Viis Narva, now Narva linn, Suur tn 5 korteriühistu, the association provided XX with the requested documents. The court terminated proceedings and, in the same order of 19 July 2012, allocated costs and quantified them. The claimant later made a separate application for further costs, which the county court granted in part.
The circuit court found that separate procedure inadmissible. When terminating proceedings, the court should have allowed time for a costs list but had not done so. The remedy was to appeal the termination order itself, not to submit a new application after it became final. The earlier order had not been appealed.
The order of 8 February 2013 was therefore set aside and the new application left unexamined. The earlier court-fee award was not reversed; the source reports that the association had already reimbursed it. The claimant bears costs of the new application. Provision of the documents and termination of the main case remained in place.
Outcome of this decision
The order of 8 February 2013 was set aside and the separate application for additional costs left unexamined. The claimant bears costs of that application; the earlier costs allocation and termination of the main case were unchanged.

The dispute and the court’s decision
OÜ Roburink sought a declaration that the meeting decisions of KÜ Linda 1, now Narva linn, Linda tn 1 korteriühistu, of 2 June 2011 were void. The company, an owner of non-residential premises, alleged that it learned of the meeting late and could not inspect the proposed financial plan, report and balance sheet in advance.
The circuit court upheld dismissal. A witness expressly confirmed placing the invitation, plan and reporting materials in the company’s mailbox before the meeting. The company did not prove non-delivery or undermine the witness’s credibility. The court considered the clarification that the mailbox was on the façade, but held that its exact location did not change the established delivery.
No defect in convening was established, so there was no basis to treat the decisions as void, without legal effect from the outset. General complaints about information and a different meeting did not replace this case’s subject; the company had brought no independent claim requiring disclosure of documents.
The appeal was dismissed and Viru Maakohus’s judgment of 2 April 2012 upheld. OÜ Roburink bears costs in both instances.
Outcome of this decision
OÜ Roburink’s appeal was dismissed and refusal to declare the meeting decisions void was upheld. The company bears costs in both instances; no separate claim for disclosure of documents was determined.

The dispute and the court’s decision
Swedbank P&C Insurance AS sought compensation for property damage from the apartment association Puškini 12. According to the history set out in the ruling, a default judgment in February 2012 awarded 3 291,33 euros in damages and 543,24 euros in state fees. It was enforceable immediately; the circuit court later reopened the proceedings by a ruling. After reopening, the parties chose to settle the dispute.
Under the agreement, the association acknowledged damage of only 700 euros and assumed 125 euros in state fee costs. The insurer undertook to return 2 466,33 euros of the funds received from the association within ten days after the ruling approving the settlement entered into force. This is a separate repayment obligation under the agreement, rather than a new amount of damages.
The parties confirmed that they had no further claims within the settlement and agreed to bear their own remaining costs. They waived further appeals. The court found that the settlement reflected the participants’ wishes and interests, approved it and terminated the proceedings by its ruling of 6 March 2013. It separately ordered the state to refund the insurer 271,62 euros, half the state fee originally paid.
The initial default award and the final settlement terms have different meanings: the final agreed compensation is not 3 291,33 euros. The act does not establish the full actual amount of damage following an adversarial determination of every argument. The copy is marked as entering into force on the day it was made; this does not confirm actual repayment or subsequent performance.
Outcome of this decision
Terminate the proceedings and approve the association’s acknowledgement of 700 euros in damage and 125 euros in state fee costs. The insurer is to return 2 466,33 euros to the association within ten days after the ruling enters into force. The parties bear their remaining costs; refund the insurer 271,62 euros, half the state fee. The participants waived appeals.

The dispute and the court’s decision
AS Swedbank P&C Insurance sought damages from KÜ Puškini 12. After no response was filed in time, the county court’s default judgment of 27 February 2012 awarded 3291.33 euros and 543.24 euros in costs. On 2 April 2012 the county court refused the association’s application to reopen the case.
The association referred to organising its defence, adopting an internal decision and engaging a representative. It had requested an extension, but the request lacked proof of authority. The insurer argued that sufficient time had been available and an earlier request was possible. In this particular case, the circuit court considered the request sufficiently justified in view of the dispute’s nature, importance to the association and the fourteen-day response period. The response submitted with the reopening application supported the expectation that an extension would have enabled a timely response. Following refusal of an extension, the association could not simply be expected to file a response before the default judgment anyway.
The refusal was set aside, the application granted and the proceedings reopened. The association was to receive a refund of its 271.62-euro security deposit. Additional reopening costs remained with the applicant regardless of the eventual claim outcome. The merits of the damages claim and the association’s final liability were not determined by this order.
After reopening, the court approved a settlement and terminated the case on 6 March 2013. The association acknowledged 700 euros in damage and 125 euros in court fee costs, while the insurer undertook to return 2 466,33 euros of the funds received to the association within ten days after the ruling enters into force. This was an agreed outcome rather than retention of the original 3 291,33-euro damages award; actual repayment was not confirmed.
Outcome of this decision
The appeal was allowed, the refusal order of 2 April 2012 set aside and the application to reopen case 2-12-4033 granted. The association was to receive a 271.62-euro security refund. The damages claim was not determined on its merits.

The dispute and the court’s decision
After debt and interest were awarded to KÜ Uus Energia, now Narva linn, Energia tn 3 korteriühistu, defendant XX appealed the judgment of 7 January 2013. The circuit court decided only whether grounds existed to admit the appeal in a simplified case.
The court explained that ordinary appeal instructions in a judgment were not equivalent to separate permission to appeal. No such permission had been given. Nor did it identify an obvious error of substantive law, procedure or evaluation of evidence materially affecting the outcome; the defendant’s disagreement alone was insufficient.
Admission was refused and the appeal returned. This order did not conduct a full appellate review of the debt; the source does not explain the specific types of charges.
Outcome of this decision
XX’s appeal was refused admission and returned. This concerned the admissibility of an appeal in a simplified case, not a new award or a full review of the debt on the merits.
The association challenged the stay of proceedings concerning meeting decisions. The circuit court set aside the stay and refused the stay application without determining the validity of the decisions themselves.

At the claimant’s request, the county court stayed proceedings until other cases ended, treating their outcomes as necessary to resolve this dispute. The association appealed the stay.
The circuit court found that sequence incorrect. Where a new confirmatory decision existed, its validity had to be resolved first. Only then could invalidation of the earlier confirmed decisions be addressed. The present case therefore did not depend on those other proceedings in a way justifying waiting for them.
Viru Maakohus’s order of 1 October 2012 was set aside and the stay application refused. Refund of the appeal fee was also refused; each side bears its own circuit-court costs. This order did not determine the validity of the meeting decisions themselves. The source states that the order was not appealable.

The dispute and the court’s decision
KÜ Puškini 45A, now Narva linn, A. Puškini tn 45a korteriühistu, appealed Viru Maakohus’s judgment of 29 November 2012 dismissing its debt claim against XX. The circuit court examined admission of the appeal in simplified proceedings.
The first-instance judgment contained no separate permission to appeal. Ordinary appeal instructions and deadlines did not replace such permission. The court also found no obvious error of law, procedure or evaluation of evidence capable of materially affecting the result; the association’s disagreement alone was insufficient.
The appeal was not admitted and was returned. No new debt award or full appellate review of the reasons for dismissing the debt claim took place. The brief order does not explain the specific charges or the reasons for dismissal on the merits.
Outcome of this decision
The association’s appeal was refused admission and returned. No debt was awarded; deciding appeal admissibility was not a fresh determination of the claim on the merits.
