The dispute and the court’s decision
Narva linn, A. Puškini tn 15 korteriühistu, named in the source as KORTERIÜHISTU PUŠKINI 15, brought a debt and interest claim against defendant XX. The court repeatedly requested correction of defects, including proof of authority for the person filing on 27 February 2013, clarification of the claim and fee information.
Later powers of attorney did not establish authority at the original filing date. The court found the defect unremedied and refused to admit the February application. This was a procedural result, not a finding that no debt existed.
The application dated 18 July 2013, however, was signed by an authorised person. The court ordered it separated and sent for proceedings as a distinct civil case. Its new number and outcome are not supplied by this source and cannot be inferred from the original case number. Entry into force and subsequent appeals have not been reverified.
Outcome of this decision
The application of 27 February 2013 was refused admission for unproved authority. The properly signed application of 18 July was sent for a separate case; the monetary claims were not decided on their merits.

The dispute and the court’s decision
Narva linn, Kreenholmi tn 33 korteriühistu, named in the source as KORTERIÜHISTU KREENHOLMI 33, sought debt and interest from defendant XX. The defendant received the documents personally but neither replied nor requested more time. The court found the unchallenged allegations and claim legally justified and granted the claim by default.
It awarded 557.03 euros in debt, 5.12 euros in accrued interest and further interest at 0.07% per day on 557.03 euros from 2 May 2013 until payment. The judgment is immediately enforceable without security.
The court awarded the 100-euro fee and statutory interest on that cost from entry into force until payment. It refused 60 euros for preparing the claim: OÜ Infolex plus had not participated as a contractual representative, and the provider’s qualifications had not been established. Actual payment, entry into force and subsequent appeals have not been reverified.
Outcome of this decision
The award comprises 557.03 euros in debt, 5.12 euros in interest, further interest at 0.07% per day on the debt from 2 May 2013 and a 100-euro fee. Statutory interest on costs runs after entry into force; 60 euros in legal costs were refused.

The dispute and the court’s decision
KÜ Punane Maja, now Narva linn, Tallinna mnt 33 korteriühistu, sought maintenance charges, water charges and late-payment interest from VETA-A Kaubamaja AS. A court-approved settlement from 2007 already governed the parties: the company contributed to maintenance but not common building repairs, undertaking repairs within its shop itself.
The company argued that the tariff included excessive costs and was unsupported for later years. The circuit court upheld the calculation: the association used a reduced tariff for the company and credited previous payments. Administrative costs could form part of maintenance; the objections did not establish a breach of the settlement. The association was entitled to reduce its monetary claim.
Parking restrictions did not justify withholding payment either. The company had not established a proper, due counterclaim sufficiently connected with the debt or the necessary conditions. A monetary claim for alleged loss was first specified on appeal and disregarded as a new argument. The court did not require a counterclaim action as the only possible defence.
The appeal was dismissed and the judgment of 25 October 2012 upheld: 6,356.13 euros in principal and 2,543.60 euros in interest, totalling 8,899.73 euros. The company bears costs in both instances; no independent entitlement to parking spaces was established by this judgment.
Outcome of this decision
The award against VETA-A Kaubamaja AS of 6,356.13 euros in principal and 2,543.60 euros in interest, totalling 8,899.73 euros, was upheld. The appeal was dismissed and the company bears costs in both instances.

The defendant received the claim documents personally but neither replied within the deadline nor requested an extension. The court granted the full claim by default and declared the judgment immediately enforceable without security. Permission to enforce does not establish that payment actually occurred.
The defendant was also ordered to pay 320 euros in costs: an 80-euro claim fee, a 45-euro payment-order fee, 192 euros for representation and 3 euros for obtaining a document. Entry into force and subsequent appeals have not been reverified.

Expedited payment-order proceedings ended because the payment proposal could not be served within a reasonable time, and the claim was transferred for ordinary civil proceedings.
The court gave the association 14 days to submit a proper statement of claim and, if necessary, pay an additional fee, warning of the consequences. Instead of a proper claim and the additional fee, the association submitted a notice that the defendant had paid the debt.
The court refused to admit the claim because the defects had not been remedied, leaving costs with the claimant. The debt claim itself was not decided on its merits; the payment report came from the association. Entry into force and subsequent appeals have not been reverified.
Outcome of this decision
Admission of the 606.39-euro claim was refused because no proper statement of claim was submitted and the additional fee was unpaid. The claimant bears costs; the merits were not decided.

The dispute and the court’s decision
The apartment association Puškini 10 sought payment from OÜ Filmarinar for building maintenance, earmarked contributions and services for the period from 1 March 2007 to 1 March 2011. After increases to the claim, the total was 6 030,64 euros. The association relied on an earlier agreement, meeting decisions, invoices and a schedule of charges. The defendant challenged the proof of costs, the documents and contractual grounds, as well as late-payment interest of 0,2% per day.
On 8 May 2012, Viru Maakohus granted the claim in full. On the defendant’s appeal, the circuit court decided the case without remitting it to the first instance. It stated that an association member’s duty to pay for management of the building arises from the law; the existence of a document called an agreement does not itself make the relationship contractual. However, grounds for treating the earlier agreement as invalid or terminated had not been properly pleaded or proved in these proceedings.
The court found the maintenance charge and earmarked roof repair contributions established by meeting decisions proven. For heating, waste collection and internet, however, the association’s invoices alone were insufficient: the actual costs and their allocation had to be proved. No additional evidence was submitted even after the appeal court invited it. That part of the claim was dismissed. The court also rejected the possibility of increasing by contract the statutory late-payment interest ceiling then applicable of 0,07% per day. The defendant’s allegations of damage were not determined as a counterclaim because no proper counterclaim had been filed.
The appeal was partly allowed. The first-instance judgment was set aside, and a new judgment awarded 4 440,26 euros: 2 195,98 euros in principal and 2 244,28* euros in late-payment interest. Costs at both instances were allocated 73% to OÜ Filmarinar and 27% to the association.
Outcome of this decision
Set aside the Viru Maakohus judgment of 08.05.2012. Issue a new judgment partly granting the claim: order OÜ Filmarinar to pay the apartment association Puškini 10 a total of 4 440,26 euros for 01.03.2007–01.03.2011, comprising 2 195,98 euros in principal and 2 244,28* euros in late-payment interest. Partly allow the appeal. Allocate first-instance and appeal costs: 73% to OÜ Filmarinar and 27% to the apartment association Puškini 10.

The dispute and the court’s decision
After a debt dispute, KÜ Puškini tn 12, now Narva linn, A. Puškini tn 12 korteriühistu, had to bear costs in both instances. The defendant XX sought quantification of legal costs. The county court awarded 200 euros for representation on appeal but refused additional first-instance costs; XX appealed that refusal.
The circuit court upheld the outcome. Recovery of representative’s costs required proof of procedural representation. In the first instance, the participant filed documents personally and the accompanying person acted as an adviser. Under the rules applied, those costs were not recoverable as representative’s costs. Representation in the circuit court, by contrast, had been established.
The association’s initial failure to object to the costs application did not oblige the court to accept every sum automatically: it could examine necessity and reasonableness. The order of 6 March 2013 was upheld and the appeal dismissed. Costs of the present appeal are not recoverable. The underlying debt claim was not reconsidered on the merits.
Outcome of this decision
XX’s appeal was dismissed and the award of 200 euros from the association upheld; additional first-instance costs were refused. Costs of this appeal are not recoverable, and the main dispute was not reopened.

The dispute and the court’s decision
Following a challenge to a meeting decision of KÜ Kangelaste pr 19, now Narva linn, Kangelaste prospekt 19 korteriühistu, first-instance costs fell on the association and appeal costs on claimant XX. Quantifying them, the county court awarded XX 399.45 euros and the association 824.15 euros. XX challenged both calculations; the association brought a cross-appeal against the order.
The circuit court reduced the association’s recovery. Reviewing the file, discussing positions and preparing the written speech partly overlapped, without adequate explanation in the earlier assessment. Reasonable legal work was assessed at four hours, or 400 euros; including the court fee, the total was 719.55 euros. The request to increase XX’s 399.45 euros was refused because the assessment of that representative’s work was justified. The court did not set these reciprocal obligations off into a single net amount.
The association’s cross-appeal was left unexamined. An independent, timely appeal against the order was necessary; receiving the other side’s appeal did not open a new period under cross-appeal rules for judgments.
The order of 17 January 2013 was varied only as to the association’s recovery. Each side bears its own appeal costs; the association bears the cross-appeal costs. The underlying meeting dispute was not reconsidered.
Outcome of this decision
XX’s liability to the association was reduced to 719.55 euros; XX’s award of 399.45 euros remained. The association’s cross-appeal was left unexamined; each side bears its own appeal costs, and the association bears cross-appeal costs.

Narva linn, Kreenholmi tn 33 korteriühistu, named in the source as Korteriühistu Kreenholmi 33, sued defendant XX for debt. The settlement fixed 392.30 euros in debt and 127.50 euros in costs, totalling 519.80 euros. Costs comprised half the fee at 37.50 euros and 90 euros for legal assistance.
The parties agreed to payments of at least 173 euros in June and July 2013 and a final payment of 173.80 euros in August. Full or partial payment delayed by at least five days allows the association to seek recovery of the entire claim through a bailiff. Delay attracts interest of 0.07% per day on the unpaid amount.
The court found the agreement lawful and capable of performance, approved it and terminated proceedings. It ordered a refund of half the fee, 37.50 euros, to the association. Actual compliance and entry into force have not been reverified.

The dispute and the court’s decision
In the debt and interest dispute between Narva linn, P. Kerese tn 2 korteriühistu, named in the source as KÜ Narv-Keskring, and Agarte OÜ, the court identified a clerical error in its order of 5 March 2013. The introduction incorrectly gave the year as 2012 instead of 2013.
The court corrected only the year and directed that a correction note be made. All other content remained unchanged. This was a technical correction, not a new debt award, a new termination of proceedings or a fresh decision on the earlier monetary claims.
The corrected order had already accepted the association’s withdrawal and terminated proceedings. The link between the decisions is expressly confirmed by the source. Entry into force of the correction order and subsequent appeals have not been reverified.

The dispute and the court’s decision
Narva linn, P. Kerese tn 2 korteriühistu, named in the source as KÜ Narv-Keskring, sued Agarte OÜ for debt and interest on 3 October 2012. After the default judgment of 13 December 2012, the association reported that the company had already paid on 24 September: its accounting service had not informed the board in time. It withdrew before the default judgment entered into force.
The court accepted withdrawal, terminated proceedings and set aside the default judgment. The company’s application to reopen the case was left unexamined because, following the withdrawal, it no longer sought a ruling on that application. This did not establish an unpaid debt.
Of the company’s claimed costs of 249 euros, the association was ordered to reimburse 83 euros for reviewing the materials and responding to withdrawal. Costs of the reopening application and related defence remained with the company; the association bears its own costs. Refunds were ordered of a 150-euro fee to the association and a 175-euro application security deposit to the company.
An order of 2 April 2013 corrected only the mistaken year in this decision’s heading: the correct date is 5 March 2013. All other content remained unchanged. Actual reimbursement and entry into force have not been reverified.
Outcome of this decision
Withdrawal was accepted, proceedings terminated and the default judgment of 13 December 2012 set aside. The company was awarded 83 euros in partial costs; refunds of a 150-euro fee to the association and a 175-euro deposit to the company were ordered. The year was later officially corrected to 2013.

The dispute and the court’s decision
In proceedings against KÜ Suur Viis Narva, now Narva linn, Suur tn 5 korteriühistu, the association provided XX with the requested documents. The court terminated proceedings and, in the same order of 19 July 2012, allocated costs and quantified them. The claimant later made a separate application for further costs, which the county court granted in part.
The circuit court found that separate procedure inadmissible. When terminating proceedings, the court should have allowed time for a costs list but had not done so. The remedy was to appeal the termination order itself, not to submit a new application after it became final. The earlier order had not been appealed.
The order of 8 February 2013 was therefore set aside and the new application left unexamined. The earlier court-fee award was not reversed; the source reports that the association had already reimbursed it. The claimant bears costs of the new application. Provision of the documents and termination of the main case remained in place.
Outcome of this decision
The order of 8 February 2013 was set aside and the separate application for additional costs left unexamined. The claimant bears costs of that application; the earlier costs allocation and termination of the main case were unchanged.
