The dispute and the court’s decision
OÜ Roburink sought a declaration that the meeting decisions of KÜ Linda 1, now Narva linn, Linda tn 1 korteriühistu, of 2 June 2011 were void. The company, an owner of non-residential premises, alleged that it learned of the meeting late and could not inspect the proposed financial plan, report and balance sheet in advance.
The circuit court upheld dismissal. A witness expressly confirmed placing the invitation, plan and reporting materials in the company’s mailbox before the meeting. The company did not prove non-delivery or undermine the witness’s credibility. The court considered the clarification that the mailbox was on the façade, but held that its exact location did not change the established delivery.
No defect in convening was established, so there was no basis to treat the decisions as void, without legal effect from the outset. General complaints about information and a different meeting did not replace this case’s subject; the company had brought no independent claim requiring disclosure of documents.
The appeal was dismissed and Viru Maakohus’s judgment of 2 April 2012 upheld. OÜ Roburink bears costs in both instances.
Outcome of this decision
OÜ Roburink’s appeal was dismissed and refusal to declare the meeting decisions void was upheld. The company bears costs in both instances; no separate claim for disclosure of documents was determined.

The dispute and the court’s decision
Swedbank P&C Insurance AS sought compensation for property damage from the apartment association Puškini 12. According to the history set out in the ruling, a default judgment in February 2012 awarded 3 291,33 euros in damages and 543,24 euros in state fees. It was enforceable immediately; the circuit court later reopened the proceedings by a ruling. After reopening, the parties chose to settle the dispute.
Under the agreement, the association acknowledged damage of only 700 euros and assumed 125 euros in state fee costs. The insurer undertook to return 2 466,33 euros of the funds received from the association within ten days after the ruling approving the settlement entered into force. This is a separate repayment obligation under the agreement, rather than a new amount of damages.
The parties confirmed that they had no further claims within the settlement and agreed to bear their own remaining costs. They waived further appeals. The court found that the settlement reflected the participants’ wishes and interests, approved it and terminated the proceedings by its ruling of 6 March 2013. It separately ordered the state to refund the insurer 271,62 euros, half the state fee originally paid.
The initial default award and the final settlement terms have different meanings: the final agreed compensation is not 3 291,33 euros. The act does not establish the full actual amount of damage following an adversarial determination of every argument. The copy is marked as entering into force on the day it was made; this does not confirm actual repayment or subsequent performance.
Outcome of this decision
Terminate the proceedings and approve the association’s acknowledgement of 700 euros in damage and 125 euros in state fee costs. The insurer is to return 2 466,33 euros to the association within ten days after the ruling enters into force. The parties bear their remaining costs; refund the insurer 271,62 euros, half the state fee. The participants waived appeals.

The dispute and the court’s decision
AS Swedbank P&C Insurance sought damages from KÜ Puškini 12. After no response was filed in time, the county court’s default judgment of 27 February 2012 awarded 3291.33 euros and 543.24 euros in costs. On 2 April 2012 the county court refused the association’s application to reopen the case.
The association referred to organising its defence, adopting an internal decision and engaging a representative. It had requested an extension, but the request lacked proof of authority. The insurer argued that sufficient time had been available and an earlier request was possible. In this particular case, the circuit court considered the request sufficiently justified in view of the dispute’s nature, importance to the association and the fourteen-day response period. The response submitted with the reopening application supported the expectation that an extension would have enabled a timely response. Following refusal of an extension, the association could not simply be expected to file a response before the default judgment anyway.
The refusal was set aside, the application granted and the proceedings reopened. The association was to receive a refund of its 271.62-euro security deposit. Additional reopening costs remained with the applicant regardless of the eventual claim outcome. The merits of the damages claim and the association’s final liability were not determined by this order.
After reopening, the court approved a settlement and terminated the case on 6 March 2013. The association acknowledged 700 euros in damage and 125 euros in court fee costs, while the insurer undertook to return 2 466,33 euros of the funds received to the association within ten days after the ruling enters into force. This was an agreed outcome rather than retention of the original 3 291,33-euro damages award; actual repayment was not confirmed.
Outcome of this decision
The appeal was allowed, the refusal order of 2 April 2012 set aside and the application to reopen case 2-12-4033 granted. The association was to receive a 271.62-euro security refund. The damages claim was not determined on its merits.

The dispute and the court’s decision
After debt and interest were awarded to KÜ Uus Energia, now Narva linn, Energia tn 3 korteriühistu, defendant XX appealed the judgment of 7 January 2013. The circuit court decided only whether grounds existed to admit the appeal in a simplified case.
The court explained that ordinary appeal instructions in a judgment were not equivalent to separate permission to appeal. No such permission had been given. Nor did it identify an obvious error of substantive law, procedure or evaluation of evidence materially affecting the outcome; the defendant’s disagreement alone was insufficient.
Admission was refused and the appeal returned. This order did not conduct a full appellate review of the debt; the source does not explain the specific types of charges.
Outcome of this decision
XX’s appeal was refused admission and returned. This concerned the admissibility of an appeal in a simplified case, not a new award or a full review of the debt on the merits.

The dispute and the court’s decision
The historical association KORTERIÜHISTU NARVA KOOLIPÕIK sought management and utility charges from owner XX. Under the settlement, the defendant admitted the claim and undertook to pay 3912 euros in 12 monthly instalments of 326 euros from 12 February 2013 through 12 January 2014; early payment is allowed.
Overdue principal attracts interest of 0.5% per day. Partial payment or a monthly payment more than five days late allows immediate recovery and enforcement through a bailiff. Current bills must be paid separately: full or partial delay over two months entitles the claimant to terminate the agreement and demand the entire balance, including new arrears, within five calendar days.
The court found the settlement lawful and capable of performance, approved it and terminated proceedings. Each side bears its own costs; the association was ordered a refund of half the fee, 137.50 euros. The appeal deadline was shortened to three days from service. Compliance and entry into force have not been reverified.
Outcome of this decision
The court approved 3912 euros in 12 monthly payments of 326 euros, with separate current-bill obligations and consequences for breach. Proceedings ended; a 137.50-euro fee refund was ordered.
The association challenged the stay of proceedings concerning meeting decisions. The circuit court set aside the stay and refused the stay application without determining the validity of the decisions themselves.

The dispute and the court’s decision
The claimant XX challenged Korteriühistu XX’s general meeting decision of 3 May 2012 confirming earlier meeting decisions. At the claimant’s request, the county court stayed proceedings until other cases ended, treating their outcomes as necessary to resolve this dispute. The association appealed the stay.
The circuit court found that sequence incorrect. Where a new confirmatory decision existed, its validity had to be resolved first. Only then could invalidation of the earlier confirmed decisions be addressed. The present case therefore did not depend on those other proceedings in a way justifying waiting for them.
Viru Maakohus’s order of 1 October 2012 was set aside and the stay application refused. Refund of the appeal fee was also refused; each side bears its own circuit-court costs. This order did not determine the validity of the meeting decisions themselves. The source states that the order was not appealable.
Outcome of this decision
The stay was set aside and the application to stay proceedings refused. The fee was not refunded and each side bears its own appeal costs; the validity of the meeting decisions was not determined.

The first-instance judgment contained no separate permission to appeal. Ordinary appeal instructions and deadlines did not replace such permission. The court also found no obvious error of law, procedure or evaluation of evidence capable of materially affecting the result; the association’s disagreement alone was insufficient.
The appeal was not admitted and was returned. No new debt award or full appellate review of the reasons for dismissing the debt claim took place. The brief order does not explain the specific charges or the reasons for dismissal on the merits.
Outcome of this decision
The association’s appeal was refused admission and returned. No debt was awarded; deciding appeal admissibility was not a fresh determination of the claim on the merits.

The dispute and the court’s decision
The apartment association Puškini 11 brought a debt recovery claim against OÜ Tellmin. After the amount claimed was paid, the association waived its claim and requested termination of the proceedings, a refund of half the state fee and reimbursement of costs. On 8 August 2012, Viru Maakohus accepted the waiver, terminated the case and ordered the defendant to bear the costs. It awarded 577,37 euros, including 417,60 euros in representation costs and the non-refunded 159,77-euro portion of the state fee. A further 159,78 euros of the fee was to be refunded to the association by the state.
OÜ Tellmin appealed against the ruling, seeking removal of the 417,60 euros in representation costs. It considered the dispute straightforward and the costs unnecessary, and referred to its own settlement proposal. The association replied that payment had been made during the proceedings and that preparing submissions and using a representative had been necessary because disagreements continued.
The circuit court upheld the ruling. Under the rule it applied, the defendant bears the costs if the claimant waives the claim because it was satisfied after proceedings were brought. The rule on costs where a claim is partly granted within the scope of a proposed settlement did not apply: the proceedings ended through waiver following full payment, rather than a partial determination of the claim. The court found reviewing the file, preparing submissions, analysing objections and the representative’s attendance at the hearing necessary and justified.
The appeal against the ruling was dismissed; the costs of that appeal were not reimbursable. The ruling reviews termination and costs; it does not award the debt again.
Outcome of this decision
Uphold the Viru Maakohus ruling of 08.08.2012. Dismiss OÜ Tellmin’s appeal against the ruling. Termination of the proceedings and the first-instance award of 577,37 euros in costs therefore remain in place. The reasons separately state that the costs of this appeal are not reimbursable.

The dispute and the court’s decision
KORTERIÜHISTU PUŠKINI 11 brought a monetary claim against Osaühing TELLMIN. After proceedings began, the company paid the principal and late-payment interest in instalments. The association withdrew its claim and sought costs and repayment of half the court fee. The company argued that the claimant should bear costs on withdrawal and challenged the need for legal expenditure.
The court accepted the withdrawal and ended the proceedings without awarding the principal again. The association cannot bring the same claim against the same defendant on the same basis again. Because payment followed the court action, TELLMIN was ordered to bear costs.
The company must pay the association 577.37 euros: 417.60 euros for representation and 159.77 euros in court fees. The 76.70 euros paid for legal assistance from Imege Grupp OÜ was not recoverable because that company had not been shown to act as a procedural representative. The necessary costs of the actual contractual representative were considered justified.
Separately, 159.78 euros in court fees was ordered to be refunded to the association from the state budget. The court included the payment-order procedure fee in the total fee paid. That refund is distinct from the 159.77 euros payable by the company. The order does not establish that the awarded costs or refund were actually received. It does not describe the particular works, services or charges underlying the original debt.
On 15 January 2013, Tartu Ringkonnakohus dismissed OÜ Tellmin’s appeal against the ruling and upheld the order of 8 August 2012. Termination of proceedings and the 577,37-euro costs award were retained; the costs of that appeal are not reimbursed.
Outcome of this decision
The withdrawal was accepted and proceedings ended after payment of the principal claim. TELLMIN must pay 577.37 euros in costs; the association is separately to receive a 159.78-euro court-fee refund.

The dispute and the court’s decision
Narva linn, P. Kerese tn 15 korteriühistu, named in the source as KERESE 15 NARVA KORTERIÜHISTU, claimed 319.56 euros in debt from defendant XX, who operated as a sole trader. It also sought 165 euros in costs: a 75-euro court fee and 90 euros for legal services. The judgment does not detail the composition of the debt.
The defendant received the documents personally but neither answered the claim nor requested more time. At the association’s request, the court entered judgment in default for 319.56 euros and declared it immediately enforceable without security.
The court awarded the 75-euro fee but refused the 90-euro legal-service cost. OÜ Infolex plus, which received the payment, had not participated as a contractual representative, and there was no information establishing that the person providing assistance met the requirements for such a representative. This concerned the particular cost claim, not the existence of the debt. Entry into force and subsequent appeals have not been reverified.
Outcome of this decision
The default judgment awarded 319.56 euros in debt and the 75-euro court fee. Reimbursement of 90 euros for legal services was refused; the judgment is immediately enforceable without security.

The dispute and the court’s decision
Narva linn, A. Puškini tn 45a korteriühistu, named in the source as KÜ Puškini tn 45A, claimed 677.43 euros in debt and 45.12 euros in interest from owner XX. The defendant disputed interest, referring to a credit for another unit and the order of payment allocation. By the hearing the association acknowledged payment of principal but maintained its interest claim.
On the association’s statement and a payment document, the court found that 45.12 euros in interest had been treated as paid on 14 June 2012. Principal was paid during proceedings. The entire claim was therefore dismissed.
The court did not decide the dispute about statutory payment allocation and correspondence because the claimed sums had already been paid. Each party bears its own costs. This was not a finding that interest charges are generally invalid; subsequent appeals have not been checked.
Outcome of this decision
The claim for principal and interest already paid was dismissed; each party bears its own litigation costs.

The dispute and the court’s decision
The claimant XX challenged the decisions of Korteriühistu Kangelaste 11, now Narva linn, Kangelaste prospekt 11 korteriühistu, of 27 April 2010 on the report, financial plan and individual items of expenditure. The county court invalidated approval of the report and dismissed the remaining claims. Both sides appealed.
The circuit court found the information duty fulfilled. Evidence showed delivery of the plan and report, display of audit materials and an opportunity to obtain copies. The provisions applied did not require personal delivery of every document to each member. Missing source documents for some costs could raise questions about performance of the board’s duties but did not itself invalidate the meeting’s decision to approve the report.
Other disputed expenditure fell within the agenda items for discussing and adopting the financial plan. The court therefore did not treat those decisions as unexpected matters outside the agenda. Lack of support for the claimant’s proposal did not make the decisions invalid either.
The association’s appeal was allowed and the claimant’s dismissed. The judgment of 13 January 2012 was set aside in full and replaced with dismissal of the claim. The claimant bears costs in both instances.
Outcome of this decision
The association’s appeal was allowed and the claimant’s dismissed. The earlier judgment was set aside in full and the challenge to the meeting decisions dismissed; the claimant bears costs in both instances.
