The dispute and the court’s decision
OÜ Sirenadi brought a claim for restitution of unjust enrichment against Narva linn, Kangelaste prospekt 11 korteriühistu, named in the order as KÜ Kangelaste 11. The dispute ended in a settlement concerning payment for and completion of works under a contract of 28 July 2010: sealing the building’s joints between panels remained unfinished.
The association undertook to pay 5752.04 euros in equal monthly instalments of 958.67 euros, with the first due on 15 November 2012 and an overall deadline of 1 May 2013. OÜ Sirenadi undertook to finish the remaining work between 1 and 31 May 2013; the association would pay a further 3195.58 euros for that work within 15 days after signing the acceptance record.
The contractor waived the late-payment interest claimed in the action. Late instalments would attract interest of 0.1% per day on the overdue amount; late completion would require the contractor to pay a contractual penalty of 0.1% per day on 3195.58 euros. The association also undertook to reimburse a 159.77-euro court fee by 15 November 2012; each side bears its other costs.
The court found the settlement lawful and capable of performance, approved it and terminated proceedings without deciding the original dispute on its merits. The parties shortened the deadline for appealing the order to three days from service. Actual performance and entry into force have not been reverified.
Outcome of this decision
The court approved reciprocal obligations to pay 5752.04 euros by instalments, complete the works and pay 3195.58 euros after acceptance, with agreed consequences for delay and reimbursement of a 159.77-euro fee. Proceedings were terminated.

The dispute and the court’s decision
The apartment association Puškini 11 brought a claim for 55 453,72 euros against OÜ Lonstrong following roof repairs. It relied on defects in the roofing and the damage they caused. The contractor initially disputed the claim, saying that the works followed the customer’s design documents, specifications and supervision instructions.
During the proceedings, the parties raised the issue of an expert examination. The source records the contractor’s advance payment for it and receipt of an expert report. The order does not disclose the expert’s conclusions. The parties then agreed a settlement at the hearing instead of pursuing a decision on the merits.
The defendant acknowledged the claim to the agreed extent and undertook to pay 31 955,82 euros. Of this, 19 955,82 euros was due by 15 November 2012, with the remaining 12 000 euros payable in twelve monthly instalments of 1 000 euros from December 2012 to November 2013. The association waived its remaining claims. The agreement resolved all disputes arising from the works contract of 9 April 2007.
The court found no obstacle to approval, confirmed the agreed terms and terminated proceedings by its order of 12 October 2012. Each party bears its own costs; half the court fee, 2 236,91 euros, is to be returned to the association. The parties waived an appeal. This was an agreed resolution, rather than an independent judicial determination of the full amount of damage. The court did, however, examine the documentary evidence collected.
Outcome of this decision
Terminate proceedings and approve the settlement: OÜ Lonstrong is to pay the association 31 955,82 euros on the agreed schedule, and the association waives the remainder of its claims. All disputes under the contract of 09.04.2007 are resolved; each party bears its own costs. Reimburse the association 2 236,91 euros in court fees. The parties waived an appeal.

The dispute and the court’s decision
Individual sole proprietor XX, owner of non-residential premises, claimed 38.11 euros from Narva linn, A. Puškini tn 45a korteriühistu, named in the source as KÜ Puškini 45A: 10.77 euros for food and 27.34 euros in lost income following electricity disconnection on 3 May 2012. The claimant regarded the disconnection as unlawful. The association relied on a warning, debt and a general meeting decision, and disputed proof of loss.
On the facts of this case, the court regarded the unchallenged general meeting decision of 11 August 2010 as binding and found its debt threshold exceeded. It found no unlawful interference with the claimant’s rights. Additionally, the claimant had not proved the amount of loss or causation between disconnection and food spoilage or lost income.
The entire claim was dismissed. The claimant must reimburse the association 145 euros in legal costs and bear their own costs. This conclusion concerns the particular dispute and is not general permission to disconnect electricity for any debt. Subsequent appeals have not been checked.
Outcome of this decision
The 38.11-euro compensation claim was dismissed; the claimant must reimburse 145 euros in legal costs to the association.

The dispute and the court’s decision
The claimant XX sued bailiff XX, buyer OÜ Wokolad and Korteriühistu XX to invalidate a forced auction and restore property rights. The first-instance court dismissed the claim. On appeal, the claimant challenged the necessity and conduct of the sale.
The circuit court found a material breach. The bailiff had already applied other recovery measures but had not established why they were not actually being implemented or collected the necessary information about repayment. Evidence indicated that the creditor could have been satisfied by means less burdensome to the debtor. Enforcement serves satisfaction of the claim, not a property sale for its own sake.
However, the court rejected the argument that auction notice had been defective: the notification requirements were met. Unexamined alternative recovery methods, rather than notice, justified invalidating the auction.
The earlier judgment was set aside in full. The new judgment invalidated the auction and recognised the claimant’s ownership. Claims to restore the ownership entry and remove the mortgage were remitted to the county court because clarification of the claims and participation of the person affected by the mortgage entry were necessary. First-instance costs will be allocated on final determination; the bailiff and OÜ Wokolad bear appeal costs jointly and severally. This does not mean register changes have already been completed.
Outcome of this decision
The auction was invalidated and XX’s ownership recognised. Claims to correct the ownership entry and remove the mortgage were remitted; the bailiff and OÜ Wokolad bear appeal costs jointly and severally, while first-instance costs remain for later determination.

The dispute and the court’s decision
The apartment association Puškini tn 19 claimed arrears from OÜ Procedendo for services related to apartment ownership. At the hearing on 28 September 2012, the parties signed a settlement and asked the court to approve it and terminate proceedings. The order does not contain detailed initial calculations or separate objections from the defendant.
The defendant undertook to pay 227,82 euros within two days after the order became final. The agreement covered the services dispute for the period before the date specified in it. Under the agreement, once that payment was made, the association would confirm that it had no other claims and waive potential existing and future claims, while expressly retaining claims for September 2012 services. The agreement therefore does not extinguish obligations for September 2012 services.
The parties agreed that they had no mutual claims concerning the proceedings being concluded and would each bear their own litigation costs. They confirmed that they understood the consequences of termination and waived the right to appeal the order. The court found the agreement consistent with their intentions and interests, approved its terms and terminated proceedings.
At the association’s request, the court ordered reimbursement of 127,82 euros, half of the 255,64-euro court fee. This is a different amount from the defendant’s payment and is not included in it. The copy bears a finality stamp dated 28 September 2012; the order records the defendant’s obligation to pay but does not itself prove receipt of funds or fulfilment of the condition for waiving the remaining claims.
Outcome of this decision
Approve the settlement and terminate proceedings. OÜ Procedendo is to pay the association 227,82 euros within two days after the order becomes final; after payment the association’s waiver of other claims applies, except for claims for September 2012 services. Each party bears its own costs. Reimburse the association 127,82 euros, half of the court fee; the parties waived an appeal.

The dispute and the court’s decision
Narva linn, Vahtra tn 2a korteriühistu, named in the source as KORTERIÜHISTU NARVA-VAHTRA 2A, sued defendant XX for debt and late-payment interest. The parties settled for 1500.41 euros: 100 euros in unpaid debt for July 2007 through April 2012 and 1400.41 euros in interest.
The court approved 36 monthly payments of varying amounts from 27 May 2012 to 27 April 2015. If the debtor complied with the scheduled amounts and deadlines, the association undertook not to charge new interest on the total debt until the schedule ended. Non-compliance entitled it to demand immediate payment of the entire debt and charge interest. The defendant also undertook to pay current bills on time.
The court found the agreement lawful and capable of performance, admitted the claim, approved the settlement and terminated proceedings. Each side bears its own costs; a refund of half the court fee, 159.78 euros, was ordered after entry into force. The parties waived appeal against the order. Actual compliance with the schedule and entry into force have not been reverified.
Outcome of this decision
The court approved a 1500.41-euro settlement with 36 instalments and terminated proceedings. Exemption from new interest depends on compliance; breach allows immediate recovery of the entire debt and charging of interest. The 159.78-euro fee refund is conditional on entry into force.

application and appeal in the name of the deleted association — KÜ Puškini 2, 2A, 4

The dispute and the court’s decision
An application made in the name of deleted KÜ Puškini 2, 2A, 4 against KÜ Narva Sõbralik sought a declaration that a transaction was void, additional liquidation and restoration of a former liquidator’s powers. These are separate legal entities with different registration codes, not alternative names for one association.
The county court required a clear claim and grounds, details of undistributed property, a claim value and payment of the filing fee. It found the defects uncorrected: neither a proper claim nor an appropriate additional-liquidation application had been filed. On 28 February 2012 it refused admission, returned the documents and left costs with the applicant.
The appeal disputed the requirements concerning form and claim value and relied on an earlier fee payment and circumstances of the other association’s separation. The circuit court upheld the refusal. The earlier fee related to a different case, and a clear claim had still not been provided after an opportunity to correct the defects. The alleged infringement could not be established from the stated facts. The validity of the transaction, entitlement to property and appointment of a liquidator were not decided on their merits.
Outcome of this decision
The county court order of 28 February 2012 remained unchanged and the appeal against it was dismissed. The application was not admitted, the documents were returned and county court costs remained with the applicant. The transaction, property and liquidator’s powers were not determined on their merits.

Former board member XX applied on behalf of the deregistered apartment association Puškini 2,2A,4 against the apartment association Narva Sõbralik (now – Narva linn, A. Puškini tn 2a korteriühistu). The applicant sought a declaration that a transaction was void, meaning it had no legal effect from the outset, supplementary liquidation, and restoration of the former liquidator’s powers. The court had previously required a clear statement of the claims and their grounds, a value for the claim, payment of the court fee, and information about the association’s undistributed assets.
Instead of a properly completed application, explanations were submitted disputing the procedural order and describing meetings and liquidation. The court considered them unclear and found that the required defects had not been remedied and the fee had not been paid. By its order of 28 February 2012, it therefore refused to accept the application for proceedings and returned it with its attachments to the person who filed it, XX. Costs were also imposed on XX.
The court did not decide the transaction or liquidation claims on their merits or find them unfounded. It explained that, following this return, the application was deemed never to have been filed or pending. Dates for the earlier order and its service conflict within the source; a reliable chronology for remedying the defects cannot be reconstructed from it.
On 18 June 2012, Tartu Ringkonnakohus dismissed the appeal against the order and left the order of 28 February 2012 unchanged. The court confirmed that the earlier filing fee related to a different case and that a clear claim had still not been provided.
Outcome of this decision
Refuse to accept for proceedings former board member XX’s application filed on behalf of the apartment association Puškini 2,2A,4 against the apartment association Narva Sõbralik; return the application and attachments to the filer. XX must bear the costs. The alleged nullity of the transaction and supplementary liquidation were not decided on their merits.

The dispute and the court’s decision
Claimant XX challenged decisions of the apartment association Narva Sõbralik (now – Narva linn, A. Puškini tn 2a korteriühistu) general meeting of 6 May 2010, seeking a declaration that they were void from adoption or an order invalidating them. The dispute concerned advance access to the management plan, report and balance sheet. The claimant said the necessary documents had not been provided two weeks before the meeting. The association objected that the convening procedure had been followed, documents had been sent, and breach of the duty to inform did not by itself prevent the meeting from taking place.
Viru Maakohus dismissed the claim on 16 May 2011. The first-instance court acknowledged that the period for examining documents had been breached but considered this insufficient to grant the claim. Claimant XX appealed for the judgment to be set aside. The circuit court agreed with the assessment of the evidence that documents had been provided late, but rejected the legal conclusion that this had no consequences. The management plan and report were handed over only three days before discussion; provision of the balance sheet had not been established. Under the rules then applied, advance access had to allow association members reasonable time to assess important management matters. That provision did not, however, require the audit committee’s report to be sent as well.
The appeal was allowed in part. The court set aside the dismissal concerning approval of the 2009 report, the 2010 budget, and the 2010 repair work and repair fund contribution rate, and itself invalidated these three decisions. Dismissal of the challenge to the fourth decision, on how received payments were accounted for, remained unchanged: the court found no connection with the established breach. Costs at both levels were allocated 25% to claimant XX and 75% to the association; the association was also ordered to pay 50 euros in court fees to the state. The result invalidates specific decisions; it does not declare every decision of the meeting void from the outset.
Outcome of this decision
Allow the appeal in part. Set aside the first-instance dismissal of the challenge to decisions under items 1–3 of the 06.05.2010 meeting and give a new judgment in that part: invalidate approval of the 2009 report, the 2010 budget, and the 2010 repair work and repair fund contribution rate. Leave the rest unchanged. First-instance and appeal costs: 25% borne by claimant XX and 75% by the apartment association Narva Sõbralik. Order the association to pay 50 euros in court fees to the state within 15 days after the judgment becomes final.

The dispute and the court’s decision
XX challenged Korteriühistu Narva Sõbralik’s meeting decisions of 6 May 2010 on reporting and the management plan. XX alleged that the board had not supplied the necessary documents two weeks beforehand. The association maintained that the materials had been delivered in time.
The first-instance court refused both to declare the decisions void from the outset and to set them aside. It distinguished convening requirements from the duty to supply financial documents in advance. It found no defect in notice of the meeting itself. However, the association had not proved delivery two weeks beforehand or delivery of the balance sheet. Receiving some materials only three days before the meeting did not properly fulfil that duty. The court found no separate duty under the applicable provision or articles to supply the audit committee report.
Despite these shortcomings, the first-instance court considered that XX could attend, ask questions and vote, and dismissed the claims. That initial result was subsequently changed in part on appeal.
The saved source includes Tartu Ringkonnakohus’s operative ruling of 11 June 2012. It set aside three decisions: approval of the 2009 annual report, the 2010 budget, and the 2010 repairs and repair-fund tariff. The remainder of the judgment was upheld. This set aside specified decisions; it did not declare every meeting decision void from the outset.
Costs in both court instances were allocated 25% to XX and 75% to the association. The association was additionally ordered to pay 50 euros in court fees to the state. The original allocation of all costs to XX did not survive. The source does not include the full appellate reasoning or establish actual payment.
Outcome of this decision
The original full dismissal was partly reversed on 11 June 2012: three meeting decisions were set aside. Costs in both instances: 25% XX and 75% the association; an additional 50-euro fee is payable by the association to the state. The remainder was upheld.

The dispute and the court’s decision
Korteriühistu Tallinna mnt 21 Narva, now Narva linn, Tallinna mnt 21 korteriühistu, sought a debt from XX. Before judgment, both sides confirmed that payment had satisfied the claim. The county court dismissed the claim and placed costs on the association.
On appeal, the association argued that the court should either have granted an admitted claim or terminated proceedings with costs against the defendant. The circuit court distinguished those situations. The defendant had not admitted the claim but reported payment and the absence of any remaining claim; the association itself confirmed performance. There was no basis to award an already performed obligation again.
To end proceedings after payment under the costs rule for withdrawal, the association could have submitted a withdrawal application. It merely cited that rule without withdrawing the claim. The court could not substitute its own decision for that expression of intention.
The appeal was dismissed and the judgment of 1 November 2011 upheld. The association bears costs in both instances. This does not mean the debt was unpaid: performance itself removed the basis for a further award.
Outcome of this decision
The association’s appeal was dismissed and dismissal of the claim following confirmed payment was upheld. The association bears costs in both instances; it had submitted no withdrawal application.
